Interfaith marriage: HC quashes FIR, says adult woman has right to live as she wishes

The Allahabad High Court has quashed an FIR lodged against a Muslim man over a marriage with a Hindu woman, ruling that she had a right to live her life on her own terms.
Upholding the interfaith marriage in a case from Uttar Pradesh's Etah district, a bench of Justice Pankaj Naqvi and Vivek Agarwal said the woman is an adult according to her high school certificate.
It said the woman, Shikha, has the right to live life according to her own wishes and terms and she has expressed her desire to stay with her husband. The bench said she is free to do so.
The judgment was delivered on December 18 on a habeas corpus petition.
The Kotwali Dehat police in Etah district had registered a case in September against the man, Salman alias Karan, under section 366 of the Indian Penal Code, which deals with "inducing" or abducting a woman to compel her into marriage.
On December 7, Etah's Chief Judicial Magistrate ordered that Shikha should be handed over to the child welfare committee. The committee then sent her to her parents the next day against her wishes.
The high court said the Chief Judicial Magistrate's order and action of the child welfare committee did not follow legal provisions.
Shikha was produced before the high court on its directions.
The court said that according to the high school certificate, her date of birth is October 4, 1999 and she is an adult.
The matter came up before the high court against the backdrop of a flurry of cases registered by the UP Police under the state's new ordinance which punishes "forcible" or "fraudulent" religious conversions, including those involving marriages.
The Etah case, however, was registered before the new law came into being. PTI

Govt extends I-T return deadline
New Delhi: Extending the deadline for the third time, the government on Wednesday allowed individuals to file income tax returns for 2019-20 fiscal till January 10. The deadline for companies and individuals who need to get their accounts audited has also been extended by 15 days (till February 15), the finance ministry said in a statement. — PTI

BJP can’t topple Maharashtra Government: Pawar

Confident that any attempt by the BJP to bring down the Maharashtra Government won't succeed, NCP supremo Sharad Pawar has asserted that the Uddhav Thackeray-led Maha Vikas Aghadi dispensation is stable and it will continue to rule the state.
He also slammed the Enforcement Directorate (ED) action against leaders of the ruling alliance and their family members as "misuse of authority". "It has been a year now (since the Thackeray-led MVA government assumed office)... they (BJP) were to bring down the government in two months, then they were to do so in six months, then in eight months. But, nothing will happen," Pawar said in an interview. "It is a stable government and it will continue," he said.
The MVA government comprising Shiv Sena, NCP and Congress completed a year last month. All through this period, various BJP leaders have been saying that the government will collapse, citing ideological differences among the alliance partners.
The BJP and Shiv Sena had contested the 2019 Assembly poll together, but their alliance fell through over the issue of chief ministership.
It was Pawar who is said to have then rallied Shiv Sena, NCP and Congress together to form the MVA government.

BJP-JJP loses two of 3 mayoral seats

A month after thousands of farmers started protests against the new farm laws, the ruling BJP-JJP alliance in Haryana suffered a setback as it lost two of the three mayoral seats and all the three municipal committee president's posts in the elections held on Sunday.
The BJP won in Panchkula where its mayoral candidate Kulbhushan Goyal defeated Upinder Kaur Ahluwalia of the Congress by a slender margin of 2,057 votes.
Former CM and Congress leader Bhupinder Singh Hooda's confidant Nikhil Madaan became Sonepat Mayor, defeating Lalit Batra of the BJP by 13,817 votes.
In Ambala, former Union minister Venod Sharma's wife Shakti Rani Sharma (Haryana Jan Chetna Party) emerged victorious, defeating BJP's Vandana Sharma by 8,084 votes. The Congress nominee finished a distant fourth.
The BJP won the lone Rewari municipal council seat where its nominee Poonam Yadav was elected president.
In the municipal committee elections in Sampla, Dharuhera and Uklana, Independents Pooja, Kanwar Singh and Sushil Sahu bagged the top post, beating Sonu (BJP), Maan Singh (JJP) and Mahendra Soni (JJP), respectively. The BJP-JJP won 11 of the 20 municipal councillor seats in Panchkula, 10 of the 20 in Sonepat and eight of the 20 in Ambala.
As the civic polls are generally won by a party that rules the state, the results are being seen as a blow to the coalition government around a year after it assumed power. More so, the BJP had won all the five mayoral posts that went to the polls in December 2018 when only a year of its term was left.
Refusing to accept that the farmers' protests had any impact on the poll outcome, Haryana BJP president OP Dhankar said they had won more wards than the Congress. "Of the seven civic bodies where elections were held, we had our MLAs only in Panchkula and Ambala. Moreover, our candidate won in Rewari, which is represented by the Congress in the Assembly," maintained Dhankar.
Former CM Hooda claimed the mandate was "clearly against the BJP-JJP coalition". State Congress president Kumari Selja said the party had contested the civic polls on its symbol for the first time, which would strengthen it at the grassroots. Venod Sharma too called it a "mandate against the ruling combine".
