Interfaith marriage: HC quashes FIR, says adult woman has right to live as she wishes

The Allahabad High Court has quashed an FIR lodged against a Muslim man over a marriage with a Hindu woman, ruling that she had a right to live her life on her own terms.

Upholding the interfaith marriage in a case from Uttar Pradesh's Etah district, a bench of Justice Pankaj Naqvi and Vivek Agarwal said the woman is an adult according to her high school certificate.

It said the woman, Shikha, has the right to live life according to her own wishes and terms and she has expressed her desire to stay with her husband. The bench said she is free to do so.

The judgment was delivered on December 18 on a habeas corpus petition.

The Kotwali Dehat police in Etah district had registered a case in September against the man, Salman alias Karan, under section 366 of the Indian Penal Code, which deals with "inducing" or abducting a woman to compel her into marriage.

On December 7, Etah's Chief Judicial Magistrate ordered that Shikha should be handed over to the child welfare committee. The committee then sent her to her parents the next day against her wishes.

The high court said the Chief Judicial Magistrate's order and action of the child welfare committee did not follow legal provisions.

Shikha was produced before the high court on its directions.

The court said that according to the high school certificate, her date of birth is October 4, 1999 and she is an adult.

The matter came up before the high court against the backdrop of a flurry of cases registered by the UP Police under the state's new ordinance which punishes "forcible" or "fraudulent" religious conversions, including those involving marriages.

The Etah case, however, was registered before the new law came into being. PTI

BJP can’t topple Maharashtra Government: Pawar

Confident that any attempt by the BJP to bring down the Maharashtra Government won't succeed, NCP supremo Sharad Pawar has asserted that the Uddhav Thackeray-led Maha Vikas Aghadi dispensation is stable and it will continue to rule the state.

He also slammed the Enforcement Directorate (ED) action against leaders of the ruling alliance and their family members as "misuse of authority". "It has been a year now (since the Thackeray-led MVA government assumed office)... they (BJP) were to bring down the government in two months, then they were to do so in six months, then in eight months. But, nothing will happen," Pawar said in an interview. "It is a stable government and it will continue," he said.

The MVA government comprising Shiv Sena, NCP and Congress completed a year last month. All through this period, various BJP leaders have been saying that the government will collapse, citing ideological differences among the alliance partners.

The BJP and Shiv Sena had contested the 2019 Assembly poll together, but their alliance fell through over the issue of chief ministership.

It was Pawar who is said to have then rallied Shiv Sena, NCP and Congress together to form the MVA government.

When asked about the ED notice to Sanjay Raut's wife, Pawar said, "This is a misuse of authority." — PTI

BJP-JJP loses two of 3 mayoral seats

A month after thousands of farmers started protests against the new farm laws, the ruling BJP-JJP alliance in Haryana suffered a setback as it lost two of the three mayoral seats and all the three municipal committee president's posts in the elections held on Sunday.

The BJP won in Panchkula where its mayoral candidate Kulbhushan Goyal defeated Upinder Kaur Ahluwalia of the Congress by a slender margin of 2,057 votes.

Former CM and Congress leader Bhupinder Singh Hooda's confidant Nikhil Madaan became Sonepat Mayor, defeating Lalit Batra of the BJP by 13,817 votes.

In Ambala, former Union minister Venod Sharma's wife Shakti Rani Sharma (Haryana Jan Chetna Party) emerged victorious, defeating BJP's Vandana Sharma by 8,084 votes. The Congress nominee finished a distant fourth.

The BJP won the lone Rewari municipal council seat where its nominee Poonam Yadav was elected president.

In the municipal committee elections in Sampla, Dharuhera and Uklana, Independents Pooja, Kanwar Singh and Sushil Sahu bagged the top post, beating Sonu (BJP), Maan Singh (JJP) and Mahendra Soni (JJP), respectively. The BJP-JJP won 11 of the 20 municipal councillor seats in Panchkula, 10 of the 20 in Sonepat and eight of the 20 in Ambala.

As the civic polls are generally won by a party that rules the state, the results are being seen as a blow to the coalition government around a year after it assumed power. More so, the BJP had won all the five mayoral posts that went to the polls in December 2018 when only a year of its term was left.

Refusing to accept that the farmers' protests had any impact on the poll outcome, Haryana BJP president OP Dhankar said they had won more wards than the Congress. "Of the seven civic bodies where elections were held, we had our MLAs only in Panchkula and Ambala. Moreover, our candidate won in Rewari, which is represented by the Congress in the Assembly," maintained Dhankar.

Former CM Hooda claimed the mandate was "clearly against the BJP-JJP coalition". State Congress president Kumari Selja said the party had contested the civic polls on its symbol for the first time, which would strengthen it at the grassroots. Venod Sharma too called it a "mandate against the ruling combine".

Cabinet approves sale of Akash missile system to foreign nations

In a major move to boost domestic defence manufacturing, the Union Cabinet on Wednesday approved the export of indigenously-developed Akash missile system and set up a panel to ensure faster approvals for export of India-made military equipment.

96% indigenous components | 25 km weapon's range

Akash is a surface-to-air missile with a range of 25 km. The missile was inducted in the IAF in 2014 and the Army in 2015. It is used largely in air defence roles, implying to bring down incoming aerial targets. The missile made by Public Sector giant Bharat Dynamics Limited (BDL) is over 96 per cent indigenous.

After its induction in the Indian armed forces, interest was shown in Akash missile by many friendly countries during international exhibitions.

So far, Indian defence exports included parts or components. The export of big platforms was minimal. This initiative of the Cabinet will help the country improve its defence products and make them globally competitive. The export version of Akash will be different from the system currently deployed with the armed forces. Besides Akash, there is interest coming in other major platforms like Coastal Surveillance System and Radars and Air platforms. To provide faster approval for export of such platforms, a committee comprising the Defence Minister, External Affairs Minister and National Security Adviser has been created. The committee will authorise subsequent exports of major indigenous platforms to various countries. It will also explore various available options, including the government-to-government route.

The Government of India intends to focus on exporting high-value defence platforms to achieve the target of $5 billion of defence exports and improve strategic relations with friendly foreign countries.


Nod to Indian missions in 3 countries

India on Wednesday banned flights from the UK till January 7 after the mutant strain was reported in 14 more UK returnees, taking the total number of people with the variant virus to 20.

Six passengers were found Covid positive with the new strain on Tuesday.

A total of 107 positive samples of passengers who recently arrived from the UK have been tested so far. Of them, 20 have the variant virus. They have all been isolated.

The Centre has also written to states and UTs to consider imposing night curfew on December 31 and January 1 to prevent super-spreading events and crowding.

After the number of cases with the new strain went up today, Aviation Minister Hardeep Puri announced that the temporary flight ban from the UK had been extended from December 31 till January 7.

The government is, meanwhile, stepping up surveillance for the new UK variant of the Covid-19 virus, which is 70 per cent more infective than the previous strain.

Health Secretary Rajesh Bhushan in his letter to state counterparts said while inter-state and intra-state movement of persons and goods would continue, the states "may impose night curfew on December 30, December 31 and January 1 to prevent super-spreading events and crowding in the wake of the New Year celebrations."

Of the 20 persons found with the mutant strain, eight samples were detected positive at the National Centre for Disease Control, Delhi; seven at NIMHANS, Bengaluru; two at the Centre for Cellular and Molecular Biology and one each at accredited labs under the Indian SARS-CoV2 Genomics Consortium.

Meanwhile, the daily recoveries have been outnumbering the new cases for 33 days. In the last 24 hours, there were 20,549 fresh cases and 26,572 recoveries.

Of the total 1,02, 44, 852 cases, 98, 34, 141 have recovered, taking the national cure rate to 95.99 per cent. Globally, India's cases per million are among the lowest at 7,423 (the US figure is 57, 319).

The toll has risen to 1,48,439 after 286 deaths in a day.

The government and protesting farm unions reached some common ground today to resolve farmers' concerns over rise in power tariff and penalties for stubble burning, but the two sides remained deadlocked over the main contentious issues of the repeal of three farm laws and a legal guarantee for MSP.

After nearly five hours of negotiations between three Union ministers and a 41-member group representing thousands of farmers protesting on Delhi borders, Agriculture Minister Narendra Singh Tomar said resolution had been reached on two of the four points on agenda.

Speaking to the media outside Vigyan Bhawan, Tomar said discussions would recommence on the remaining two points on January 4 at 2 pm. The concerns of the farmers on the draft Electricity (Amendment) Bill and the Air Quality Management Ordinance (containing penal provisions for stubble burning) had been addressed, he said.

Tomar lauded the farm leaders for maintaining peace and discipline during their protest, but urged them to send the elderly, women and the children back home due to the extreme weather. He said the union leaders insisted on repealing the laws, but the government side tried to explain to them the benefits of the Acts and sought to know the specific points they feared. On legal guarantee for MSP (minimum support price), the minister said the government had already declared that it was ready to give a written assurance. Tomar was accompanied by Railways Minister Piyush Goyal and Minister of State for Commerce Som Parkash.

Farm union leaders Balbir Singh Rajewal, Ruldu Singh and Gurnam Singh Charuni said after the meeting that they had decided to defer tomorrow's tractor march from Singhu to Tikri via the Kundli-Manesar-Palwal Expressway. The farm leaders, however, said they had made it clear to the government that decision on repealing the laws would be key to ending the impasse.

While the three ministers joined the farm leaders to share their 'langar' during the lunch break, the union representatives accepted the beverage offered by the government during the evening tea break. In the last five meetings, farmer leaders had refused to accept even water offered by the government.

Judiciary is getting ‘executivised’: Justice Madan B Lokur

Justice Madan B Lokur, who retired as a judge of the Supreme Court of India on December 30, 2018, has been one of the most vocal judges in India. Currently, he is serving as a judge of the Supreme Court of Fiji since August 12, 2019. In an interview with The Tribune Legal Editor Satya Prakash, Justice Lokur articulated his views on a host of issues confronting the Indian judiciary. Excerpts:

How do you see the role of the judiciary in India? What would you expect the constitutional courts to do? Have they performed the role you expect them to?

The judiciary is obviously a very important institution in a democracy. I believe the days of an ivory tower judiciary are now over. The judiciary must appreciate this and be proactive in taking forward the constitutional vision of justice ndash; social, economic and political. I expect every judge, not only constitutional courts, to be proactive, without fear or favour, affection or ill will. By and large the judges have performed their role as expected, but I think some of them have been a bit tentative over the last few years.

In the recent past, you have been critical of the judiciary in general and the Supreme Court in particular. Why? Please elaborate.

I am sorry that by expressing my views, I seem to have conveyed this impression. I have and will continue to have great regard and respect for an independent judiciary. Certain events have transpired over the last few years that have dismayed me. For example, some of us felt that the then Chief Justice of India (CJI) was misusing his authority as Master of the Roster despite being cautioned. Four senior judges of the Supreme Court (including myself) spoke out against it. Matters did improve, but only temporarily. The next CJI went a few steps further down the slope in an unbelievable manner when he dealt with allegations of sexual harassment against himself.

Many (including myself) spoke out against what had happened. The Supreme Court then declined to give appropriate importance to some cases, such as those concerning electoral bonds, Citizenship (Amendment) Act, habeas corpus petitions, cases of alleged violations of fundamental rights and liberties such as free speech and freedom of the Press and so on, including the terrible hardships faced by migrants as a result of the lockdown.

A few months ago, about 20 senior lawyers of the Supreme Court addressed a letter to the CJI and all other judges articulating the Supreme Court's "failure to protect the rights of the hapless millions of migrant workers in March and its failure to scrutinize the executive actions hellip;. that severely and excessively impaired the fundamental rights of the poorest sections of our citizens".

Even today, some lawyers are expressing their distress and dismay at some other developments.

The problem is that the High Courts and District Courts then begin to think that if the Supreme Court adopts a particular attitude or takes a particular stance, why should we take a different line. So, the judicial process down the line gets vitiated. That is troubling and in the overall context, it engenders the feeling that the Supreme Court and the judiciary is getting executivised.

There were questions raised over the manner in which the Supreme Court handled the situation arising out of the COVID-19 pandemic and the subsequent lockdown during which thousands of migrant workers were seen walking back home on foot? Did it fail in its constitutional duty of protecting citizens' right to life enshrined under Article 21 of the Constitution?

The letter sent by the Supreme Court lawyers says it all.

The Legislature and the Executive often accuse constitutional courts of judicial overreach while activists feel the judiciary is not active enough to keep the other two organs of the State under check. What do you think?

It's a mixture of both. Judicial overreach is when the Judiciary passes orders in areas which are beyond its jurisdiction. Legislative overreach is when the Legislature passes laws that are outside its jurisdiction. These laws are then declared unconstitutional by the judiciary, which is then accused of overreach. Executive overreach is when the Executive passes orders or gives directions that are beyond its jurisdiction. These are then struck down by the judiciary. This is a constitutional obligation of the judiciary and cannot be characterised as judicial overreach.

There have been instances when the Speaker of the House has not taken action under the anti-defection law for months or when there is what the Supreme Court described as horse trading of MLAs. In such situations, when a citizen approaches the Court, there are two options before the Court -- one is to tell the litigant that it's for the Legislature and the MLAs to sort out their problems. The other is to intervene in accordance with the Constitution and pass appropriate orders. If the Court keeps a hands-off attitude, it is accused of not being active enough. If the Court intervenes, it is accused of judicial overreach. This is an unfortunate dilemma.

Yet another problem is when the Legislature or the Executive is inactive. Why is it that no law was provided to protect women from sexual harassment at the workplace? Due to the silence of the Legislature, the Supreme Court was compelled to issue the Vishaka guidelines in 1998. Was it a case of judicial overreach? If yes, what was the alternative ndash; to let women continue getting sexually harassed?

Even thereafter, the Legislature was silent for almost 15 years and ultimately enacted a law in 2013. Similarly, existing laws for the protection of children are not being faithfully implemented by the Executive. If the Supreme Court passes orders for the effective implementation of these laws, is that judicial overreach? In such situations, citizens and the Courts ask the question ndash; to act or not to act. My view is that the Courts must act ndash; the Constitution of India mandates it.

How do you see the relationship between the Government and the judiciary today?

If you read the full text of the letter sent by the Supreme Court lawyers, you will get the answer to your question.

More than five years have passed since the Supreme Court declared NJAC as unconstitutional. The Collegium system is under attack for being opaque and ignoring talent in elevation to the Bench. What kind of changes would you suggest in the judicial appointment system?

Recently, I participated in a webinar on judicial integrity and the appointment of judges came up for consideration. A judge from a court in Europe said that in Europe there were 50 different ways in which judges are appointed. Another European judge on the panel did not contradict him. So, there are ways and ways in which judges can be selected for appointment. No system is perfect, including our collegium system. At one time, I suggested five different changes in the functioning of the collegium to reduce opacity. These were immediately accepted by the CJI and other judges in the collegium.

Later, I gave another set of suggested changes to the concerned Registrar in the Supreme Court. I believe he handed over the suggestions to the CJI or brought them to his notice but they were not discussed. Changes are needed and should be made. Pinpointing them will need a separate discussion altogether. Yes, some outstanding lawyers have been side-lined for appointment and some outstanding judges have not been fairly treated.

In the recent past, the Supreme Court has initiated contempt proceedings against several persons, including advocate Prashant Bhushan and comedian Kunal Kamra. Do you think the Supreme Court is becoming averse to criticism or it's being unfairly targeted by certain people? Should India do away with criminal contempt of court, particularly scandalising the court as defined under Section 2 copy; (i) of the Contempt of Courts Act, 1971?

I think the Supreme Court is being unnecessarily defensive. It has been criticised by senior politicians who have pejoratively used expressions like judicial activism and judicial overreach. The Supreme Court has not reacted to this criticism. Why take action against non-political individuals? It is not possible for every criticism to be fair, not is it possible for every judgment to be right. Listen, correct (if necessary) and move on.

A former Law Minister used rather intemperate language about the Supreme Court to the effect that "Antisocial elements i.e., FERA violators, bride burners and a whole horde of reactionaries have found their heaven in the Supreme Court." The Supreme Court said that if it is true, it is a criticism of the laws. "If antisocial elements and criminals have benefited by decisions of the Supreme Court, the fault rests with the laws and the loopholes in the legislation. The Courts are not deterred by such criticisms."

You were a part of the group of four senior-most judges who held a press-conference in January 2018 on the issue of the master of roster controversy. Do you think the system needs to be streamlined? How can it be fixed?

The Chief Justice of a High Court is also the Master of the Roster, but I have seldom heard of any misuse of power by any of them. Recently, Justice Rajinder Sachar of the Delhi High Court did mention, in his worth reading autobiography, of one case of such misuse by the Chief Justice in a case pertaining to the 1984 riots/pogrom in Delhi. He protested against it by going on leave. There might possibly be other stray instances, but nothing systematic, as far as I know. Obviously, these stray instances would have been sorted out one way or the other, with or without protest.

However, if the Chief Justice misuses the system and is adamant, unyielding and not willing to listen to reason, despite being advised by four senior judges, he or she is inviting a protest in some form or the other. Most judges in the Supreme Court have been Chief Justices in one or more High Court. The CJI can always consult them and streamline the system.

Pandemic has forced courts to function virtually and made it heavily dependent on information technology. What are the pros and cons of this switch over to technology? Has it affected the quality of justice delivery?

There are several pros and cons in embracing information and communication technology in justice delivery. I am certain that without the use of technology our justice delivery system will collapse. But there is a need to brainstorm so that communication is secure, robust and effective and lawyers don't attend court in a vest. As yet, there is no study or evidence to suggest that online justice delivery has affected the "quality of justice". It's a little premature to comment.

Over the years, the pendency of cases has been one of the biggest problems faced by the judiciary? How can it be tackled? What ails the Indian judiciary?

These two questions require a long and detailed discussion. But let me quote Lord Devlin: "If our business methods were as antiquated as our legal system, we would have become a bankrupt nation long back." He added, with reference to some deficiencies, that they are indeed "a subtle threat to the independence of the judicial system." Reforms are certainly needed and they are needed now. Let us start with case management and process reengineering.

Prime Minister Narendra Modi attacks previous govts for delay in freight corridor project

Prime Minister Narendra Modi on Tuesday accused previous governments of delaying the dedicated freight corridor project and ignoring modernisation of the Railways, saying politics should be kept away from infrastructure development.

Inaugurating the New Bhaupur-New Khurja section of the Eastern Dedicated Freight Corridor (EDFC) via video-conferencing, he said the "roar" of Bharat and 'Aatmanirbhar Bharat' (self-reliant India) were clearly heard as the first freight train operated on the Khurja-Bhaupur section, and asserted that the corridor would also help farmers transport their harvest on time.

Modi to lay stone of AIIMS-Rajkot tomorrow

Prime Minister Narendra Modi will lay the foundation stone of the All-India Institute of Medical Sciences in Rajkot, Gujarat, on December 31 via video-conference, the PMO said on Tuesday. To be built over 201 acres, the Rs1,195-crore project is expected to be completed by mid-2022, the PMO said. PTI

The Prime Minister also deprecated the tendency of people to target infrastructure during protests and demonstrations, saying infrastructure did not belong to any leader, political party or government but was that of the country and its citizens. Stressing that this project was the living example of the work culture of the government at the helm before 2014, Modi said the freight project was given permission in 2006, but it was only on paper as the then government lacked the "seriousness and urgency" with which it had to take it up with the states.

After 2014, the project was restarted and officials asked to take it forward and by then the budget had gone up by 11 times, he noted.

The Prime Minister said on coming to power, he personally monitored the project and held a dialogue with stakeholders, and got new technology as a result of which about 1,100-km work would be completed in the next few months.

"Imagine not a single km in eight years and 1,100 km in six to seven years," he said. The 351-km section has been built at a cost of Rs 5,750 crore. The EDFC is 1,840-km and extends from Ludhiana in Punjab to Kolkata in West Bengal. Modi also inaugurated the EDFC's operation centre at Allahabad and flagged off the first 1.5-km goods trains. The Prime Minister said political apathy not just hampered the freight corridor project, but also had a bearing on the entire Railways. — PTI

India today became the 14th country to confirm the presence of a new and more infectious strain of the Covid-19 virus with six persons who returned from the UK between December 21 and 23 testing positive. The samples of all international passengers who arrived between December 9 and 22 and tested positive will be subjected to genome sequencing to detect the mutant strain.

The Union Health Ministry said the six persons were in isolation, their contacts had been quarantined and contact-tracing was in progress. In all, 33,000 passengers from the UK disembarked across Indian airports between November 25 and December 23. Of them, 114 have been found positive and their samples had been sent for genome sequencing, said officials. "This is an ongoing process," Health Secretary Rajesh Bhushan said today as India stepped up surveillance for virus mutations.

Rakesh Mishra, Director, Centre for Cellular and Molecular Biology (CCMB), Hyderabad, one of the 10 labs in the national genome sequencing consortium tracking Covid positive UK returnees, today said the variant "is not worse than the others and clinically does not present different or severe symptoms, but it is much more transmissible".

"Most people with the mutant strain are asymptomatic as is the case with normal strain where 80 per cent cases are mild," he said.

Of the six passengers with the variant, three were tested at NIMHANS, Bengaluru, two at CCMB, Hyderabad and one at NIV, Pune.

Mishra said the variant had a greater capacity to infect people and that was a matter of concern as India witnessed second largest number of cases after the US and variants could emerge from within the country as well. — TNS

Indian economy on strong wicket: UN

India's economy could prove to be the "most resilient" in the subregion of South and South-West Asia over the long term, according to a report by the UN. It says the country's large market will continue to attract investments.

The report, 'Foreign Direct Investment Trends And Outlook In Asia And The Pacific 2020/2021', compiled by the United Nations Economic and Social Commission for Asia and the Pacific, said the inward FDI flows to South and South-West Asia slightly decreased by 2 per cent in 2019, from $67 billion in 2018 to $66 billion in 2019.

The growth, however, was mainly driven by India, which accounted for 77 per cent of the total inflows to the subregion and received $51 billion in 2019, up 20 per cent from the previous year.

The report said the majority of these flows were destined for the information and communications technology (ICT).

Regarding the ICT sector, the report said the investment to India had evolved from information technology services for multinational enterprises to the thriving local digital ecosystem where many domestic players had attracted international investment.

The report added that FDI outflows from South and South-West Asia increased for the fourth consecutive year, modestly growing from $14.8 billion in 2018 to $15.1 billion in 2019. The report noted that in the short term, both inflows and outflows from and to the subregion were expected to decline.

"India's economy, however, can prove the most resilient in the subregion over the long term. FDI inflows have been rising, albeit lower, growth after the pandemic and India's large market will continue to attract investment," it said. — PTI

The Sanyukt Kisan Morcha, an umbrella body of 40 protesting farmer unions, on Tuesday stressed it would hold talks with the Centre as per the four-point agenda decided by it.

Formally accepting the invitation of the Union Government for the next round of talks, the Sanyukt Kisan Morcha in a letter today to Agriculture Secretary Sanjay Agarwal said: "The farm unions will hold talks on the four-point agenda sent earlier to the government."

The farm leaders sent the four conditions again to the Centre while emphasising that for a logical solution to all relevant issues, it would be required that "our dialogue runs according to the agenda".

The unions also clarified that they had earlier sought "necessary changes" in the Electricity Amendment Bill draft but now they wanted it to be revoked.

The Centre had yesterday invited 40 farm unions for the next round of talks on December 30 at 2 pm at Vigyan Bhavan in New Delhi. Responding positively, the unions had accepted the invite.

Harinder Singh Lakhowal, BKU (Lakhowal) general secretary, meanwhile, said: "We are going for talks with the government with an open mind, but the latter's intention is not clear. The Centre wants the impasse to continue and defame the protest."

New phase of electoral bonds in January

With Assam and West Bengal Assembly elections coming up, the government announced a 10-day window from January 1 for the 15th phase of sale and encashment of electoral bonds.

The bonds will be valid for 15 days from the date of issue and no payment shall be made if political parties deposit them after the validity period. Only the State Bank of India is authorised to issue and redeem the electoral bonds through 29 branches. BJP using Central agencies to topple Maharashtra Govt: Raut

Launching a veiled attack on the Centre after the ED summoned his wife, Shiv Sena MP Sanjay Raut on Monday alleged Central agencies were being used to "destabilise" the Uddhav Thackeray-led government in Maharashtra and claimed BJP leaders had been in touch with him for over a year to effect this plan.

Seventy-three tourists, camping in the Kareri Lake area who had got stuck there due to heavy snowfall, were rescued by the local administration today.

Kareri Lake is a popular trekking destination located 10 km uphill from Dharamsala amid Dhauladhar range at an altitude of around 3,000 metre from the sea level. The district administration had to send police personnel, home guards and locals to rescue tourists.

Kangra Deputy Commissioner Rakesh Prajapati said all 73 stranded tourists were rescued and brought to Dharamsala by the evening.

They were given first-aid and then allowed to move to their respective places. "They are all fine," sources said. Upper areas of Dharamsala received heavy snowfall yesterday night, bringing down the temperature in the entire Kangra valley.

Smart City Hotel and Restaurant Association general secretary Sanjeev Gandhi said all hotels that had gone functional in the upper Dharamsala area were packed to capacity for New Year's Eve. — TNS

An order passed by the Jammu and Kashmir High Court today made it clear that all is not well with the union territory of Jammu and Kashmir, the latest being "total arbitrary exercise of power" in the allotment of liquor vends virtually "for all times to come by the finance minister concerned".

The Bench of Chief Justice (Acting) Rajesh Bindal and Justice Sanjay Dhar asserted the court was once again being called upon to clear the skeletons from the cupboard in the UT. Information by the government counsel revealed that 223 liquor vends were at present functional in Jammu and Kashmir. These were continuing with the same persons or their successors in interest for decades. "The process for the renewal of licences was being followed where admittedly allotments had not been made in a transparent manner. The same were done only on the recommendation of the finance minister concerned," the Bench added.

Directing the adoption of a transparent method, the Bench added the process was not to be limited to the persons in power or close to the corridors of power "as had been the practice". Setting aside clauses providing for renewal of licences for five years for 2017-18 to 2019-20, the Bench added the government would be at liberty to frame new excise policy for 2021-22. For avoiding a vacuum and possible loss of revenue to the government, the Bench allowed operation of the vends till March 31, 2021.

New US law a ray of hope, say Tibetans

Tibetans-in-exile have welcomed US President Donald Trump signing the Tibetan Policy and Support Act (TPSA) into law.

"This legislation sends a powerful message of hope and justice to the Tibetans inside Tibet and bolsters US support for the protection of Tibetan people's religious freedom, human rights, environmental rights and exile Tibetan democracy like never before,'' said "Central Tibetan Authority President'' Lobsang Sangay.

The move strengthens US policy on Tibet and reaffirms its government's steadfast support for the Dalai Lama and the CTA, he added.

The Bill called upon the US Secretary of State not to authorise any new Chinese consulate till a US Consulate is established in Lhasa. The signing came after days of delay though the US Congress had approved the omnibus spending bill, which had the TPSA attached on December 22.

Built on the Tibet Policy Act signed by George Bush, the TPSA makes it official that decisions regarding the reincarnation of the Dalai Lama are exclusively within the authority of the current Dalai Lama, Tibetan Buddhist leaders and the people. The Union Finance Ministry has dug in its heels against petitions to postpone the last date for filing several returns, including for income tax (I-T) for assessment year 2020-21.

This exhortation is accompanied by statistics of I-T returns filed. For instance, the Finance Ministry in its fourth post on Monday reported that 7.10 lakh I-T returns were filed till 5 pm. It put the cumulative figure till that hour at 4.23 crore for assessment year 2020-21.

The postponements have been sought mainly because internal trade remains disturbed due to Covid.

Several associations, trade unions, professionals and Parliamentarians have sought staggered extensions in deadlines for various returns. They want the due date for filing annual returns for GST postponed to January 31 and for I-T returns to March 31.

The Government does not want to defer the implementation of Rule 86B in GST that levies mandatory cash payment of 1 per cent tax for businesses with monthly turnover of over Rs 50 lakh. The Confederation of All-India Traders (CAIT) cited enhanced compliance burden and financial obligation for traders in seeking a deferment but the government has stated that this provision will curb fake invoicing.

BJP using Central agencies to topple Maharashtra Govt: Raut

Launching a veiled attack on the Centre after the ED summoned his wife, Shiv Sena MP Sanjay Raut on Monday alleged Central agencies were being used to "destabilise" the Uddhav Thackeray-led government in Maharashtra and claimed BJP leaders had been in touch with him for over a year to effect this plan.

Sharad Pawar-led Nationalist Congress Party (NCP) and the Congress are constituents of the Shiv Sena-led Maha Vikas Aghadi (MVA) government, which was formed in November 2019 after the Sena and the BJP fell out over sharing the post of chief minister following the Assembly elections.

"Some BJP leaders have been contacting me for the last one year, saying they have made all the arrangements to destabilise the Maharashtra Government. They have been pressuring and threatening me not to support the government."

The Enforcement Directorate (ED) summoned Varsha Raut for questioning in the PMC Bank money laundering case on December 29, officials had said on Sunday. This is the third summons issued to her after she skipped the earlier two on health grounds, they said. As Rahul left on a short personal visit abroad yesterday, the Congress rose in his defence, saying he was not the incumbent party president.

"Rahul Gandhi is currently not the Congress president. He is discharging the responsibility the party gives himhellip;. Can't he go to visit an ailing family member? He is on a short personal visit to see a seriously ill family member. He is not on leave. He has also gone to visit his maternal grandmother. I don't think the BJP should have any objection to this," Congress media head Randeep Surjewala said, answering queries about the conspicuous absence of Rahul from the party's most important annual event, especially at a time when some dissenters are active in the party.

Surjewala, who attended the ceremony, however, sought to deflect the issue and said the question today was not where Rahul was. "The question is what the Centre is doing to ease the pain of agitating farmers," asked Surjewala.

AICC general secretary Priyanka Gandhi Vadra, who was present at the ceremony, attacked the Centre for calling farmers "anti-national". Ghulam Nabi Azad was also on the dais with Antony.

MHA extends Covid norms till January-end

In a statement, the MHA said it had issued fresh guidelines for surveillance with regard to Covid-19 and these would remain in force till January 31.

Vax dry run smooth in 2 Punjab districts

A two-day dry run to check the preparedness of health authorities for a future Covid-19 vaccination programme began smoothly today in Ludhiana and Nawanshahr districts of Punjab.

  • Were called via SMS (treated as ID) sent on their mobile phones

Punjab is one of the four states selected by the Centre for the mock drive, aimed at testing the laid out mechanism for the vaccination programme. The other three are Andhra Pradesh, Assam and Gujarat.

Health Minister Balbir Singh Sidhu said the exercise would provide insight into any gaps or bottlenecks in vaccine distribution and its administration so that those could be addressed before the commencement of the immunisation drive.

In Ludhiana district, seven centres have been set up for the drill—Lord Mahavir Civil Hospital, Dayanand Medical College and Hospital, sub-divisional hospitals at Jagraon, Raikot and Khanna and the community health centres at Dhamot and Machhiwara.

In Nawanshahr district, there are five centres: District Hospital, IVY Hospital (Nawanshahr city); Community Health Centre, Mukandpur; Primary Health Centre, Jadla, and Sub-Centre, Usmanpur. For each centre, 25 persons, who had registered online, were selected.

State's nodal officer for Covid Dr Rajesh Bhaskar said, "The drill was conducted smoothly. We had to finish the task in two hours between 9 am and 11 am, but we completed it half an hour early."

The details of 1.5 lakh healthcare workers from private and public facilities had already been uploaded on CoWIN portal for vaccination. All vaccine beneficiaries have to compulsorily pre-register on CoWIN portal through their photo ID.

Punjab has identified 729 cold chain points. Three regional state vaccine stores are to be created in Amritsar, Hoshiarpur and Ferozepur.

The Centre today launched a genomics consortium to roll out a national plan for conducting genome sequencing of Covid positive samples to study any potential mutations and understand if local outbreaks are caused by transmission of single or multiple viral lineages.

Analysis of SARS-CoV-2 genome sequences is critical as it would allow the Health Ministry to study the evolution of the virus and assess whether the viral mutations influence transmission, clinical outcomes, severity, or if they impact public health interventions and vaccine efficacy. Ten designated laboratories spread across the country will cater to the nearest states which will send 5 per cent of the positive samples to these labs for genome sequencing.

The consortium was considered critical after the United Kingdom faced a spike in cases due to a new mutation.

The ministry said: "The United Kingdom variant is significantly more transmissible with an estimated potential to increase the reproductive number (R) by 0.4 or greater with an estimated increased transmissibility of up to 70 per cent."

Meanwhile, 20,021 fresh infections and 279 fatalities were reported in the past 24 hours. The recovery rate is 95.83 per cent and case fatality rate is static at 1.45 per cent. Active cases have been under 3 lakh for seven days.

Rajinikanth discharged from hospital

Hyderabad, December 27

Superstar Rajinikanth was on Sunday discharged from a hospital here, where he was treated for blood pressure fluctuation, after his condition improved, authorities said. "His blood pressure has been stabilised and he is feeling much better. In view of his improved medical condition, he has been discharged from the hospital today," a bulletin from Apollo Hospitals said.

The 70-year-old actor was admitted to the hospital here on December 25 with severe hypertension and exhaustion, it said. He was kept under close medical supervision and treated by a team of doctors.
